Contributors FUSION ENTERPRISES LIMITED The directors and staff of Fusion Enterprises Limited are dedicated local people who work with the ever increasing Hastings student community. Fusion’s aims are to encourage students to fully enjoy all the benefits that Hastings can offer and particularly those available through local businesses. Fusion’s current product is the Fusion Discount Card linked to the Fusion web site. Local businesses are invited to join the Fusion family of benefits as Contributors on the following basis: 1. For the academic year 2009 to 2010 there will be no charge to Contributors to join the Fusion scheme. 2. The Fusion card is issued to students of all ages. It is the intention of Fusion to expand the scope of the card to other student bodies and to all educational establishments as appropriate. Please ensure that card holders are only provided with services and benefits that it is appropriate for that Card Holder to enjoy. Particularly note and observe term 7 below. 3. Contributors agree to only offer the following discount schemes: Fusion, National Union of Student and their own (if any). 4. Once a Contributor, we ask you to give one months notice of exiting the scheme and of changing your discount rate or terms. 5. Contributors undertake with us to ensure that all students producing their Fusion Card will be given the discounts and/or other benefits offered through the scheme without reservation. 6. Fusion, of course, cannot take any responsibility for Card Holders, gives no representations in regard to Card Holders and do not guarantee any rate of usage of the card. 7. If the Contributors premises are licensed or the business and/or it’s premises, products and services are subject to any restriction whatsoever on customers’ usage, the Contributors agree to ensure that they vigorously enforce all such restrictions and laws in regard thereto. The production of a card does not, under any circumstances, indicate that Fusion has vetted those producing it to be qualified for the product or services or for entry into premises. It is the Contributors duty to vet all such users and undertakes with Fusion to do so. Failure to do so will lead to immediate removal from the scheme. 8. The Contributor agrees to ensure, as far as it is able, that the good repute of the Fusion Card and associated products is maintained and will not allow any action or failures on the part of the Contributor, its directors, partners, staff, subcontractors and associates to occur that will denigrate the good repute of the Card and associated products. 9. Fusion have the right to amend, add to or delete any conditions and rules of the scheme but will give one months notice of any changes unless, in the opinion of Fusion, it is necessary to give less notice. 10. The participation by Contributors in the scheme does not give rise to any liability by Fusion to Contributors. The Contributor agrees that Fusion shall have no liability to Contributors. Contributors agreed to keep Fusion indemnified against any liability that devolves onto Fusion through the activity of, or otherwise originating from, a Contributor or its associates. 11. In the unlikely event of Fusion wishing to terminate a Contributors participation in the scheme Fusion will give one months notice of termination. If the Contributor has breached any of Fusions rules the company reserves the right to terminate the participation without notice. 12. Contributors agreed to ensure that only the cardholder stated on the signature strip is offered the discounts and will only give Fusion discounts on presentation of the Fusion card. The card must be presented on every occasion that discounts are given.
